'Making a Murderer': Prosecutors appeal Brendan Dassey's overturned conviction

The Wisconsin attorney general on Friday appealed the overturned murder conviction of Making a Murderer subject Brendan Dassey, according to the Associated Press. The appeal keeps Dassey incarcerated.

“We believe the magistrate judge’s decision that Brendan Dassey’s confession was coerced by investigators, and that no reasonable court could have concluded otherwise, is wrong on the facts and wrong on the law,” Republican Attorney General Brad Schimel said in a press release, via the AP.

Dassey was convicted for helping his uncle, Steven Avery, kill photographer Teresa Halbach in 2005 when Dassey was 16 years old. Dassey was shown in the Netflix docuseries being introverted, quiet, and eager to please anyone he was speaking with. His attorneys argued his constitutional rights were violated during the investigation. A federal judge agreed with them last month. “These repeated false promises, when considered in conjunction with all relevant factors, most especially Dassey’s age, intellectual deficits, and the absence of a supportive adult, rendered Dassey’s confession involuntary under the Fifth and Fourteenth Amendments,” Federal Magistrate William Duffin of Milwaukee wrote in his ruling.

Prosecutors had 90 days to decided to retry Dassey, who was convicted in 2007, or else he would have been freed from prison. “We look forward to continuing to defend his rights in court,” Dassey’s attorney Steve Drizin said, per the AP. “Like Brendan, we remain grateful to his many supporters for their continued loyalty and strength.”

Dassey’s uncle, Avery, remains in prison. His attorney Kathleen Zenner told The New York Times last month she plans to order evidence tests that could eventually lead to Avery’s exoneration.
